Request for Proposal for Legal Services for Hertford County Public Schools Board of Education
Hertford County Public Schools (HCPS) is requesting proposals from qualified attorneys to provide general counsel to the Board of Education. The contract term is for three years beginning July 1, 2019 and ending June 30, 2022. Services will include but not limited to advising the HCPS Board of Education on all legal matters as it pertains to the North Carolina Public School and Personnel Law. The attorney will be required to attend all meetings held by the Board of Education and shall be retained to provide legal advice on an as need basis. The HCPS district is located in eastern North Carolina. The HCPS Board of Education office is located in Winton, North Carolina. The school district has 7 schools and 2,800 students. The district has approximately 555 full-time employees. The Board of Education is comprised of five members who are elected at large and represent the entire district. The Board of Education has one scheduled action meeting a month typically held in the early evening. Additional meetings may be scheduled on an as need basis.
Legal Firms wishing to submit a proposal shall provide documentation supporting prior North Carolina Public School Law experience and must be licensed to practice law in the State of North Carolina. All proposals shall list references from existing or prior North Carolina Board of Education clients. The proposal shall include the monthly retainer fee and the hourly rate for services provided on an as need basis. Please specify if the retainer fee includes the attendance of the monthly Board of Education meetings.
The attorney or firm representing the Hertford County Public Schools Board of Education will be expected to provide the following services:
Attend all Board business meetings as requested and assist in maintaining Closed Session minutes
Provide advice and consultation in respect to issues relating to Open Meetings Law and Freedom of Information Law
Consult as needed with the Board and Board Chairperson as well as the Superintendent about legal matters
Represent and negotiate on behalf of the board in legal matters
Review all potential board decisions and contractual agreements and make recommendations to the board
Be available upon short notice to handle time sensitive matters
At least annually provide training to the Board of Education on procedural guidelines to conduct Board business and admonish and advise the Board when potential procedural violations appear imminent
At all times serve as an advocate for the Board of Education
Proposals signed by authorized officials will be received by Dr. Shamica Long-Lane, Executive Director of Human Resources at Hertford County Public Schools, 701 N. Martin Street, Winton, NC 27986 until June 14, 2019 at 5:00 p.m. Envelopes containing proposals should be clearly identified on the front with the words “RESPONSE TO RFP FOR LEGAL SERVICES”. The Superintendent will review the proposals and make a recommendation to the Board of Education for approval on June 24, 2019.
